So in that way of thinking it doesn't matter if you're guilty or innocent, or falsely accused. If convicted you're being punished for something you would eventually do anyway.<br />The reason this can't be quantified more than it is (although with DNA it is becoming easier) is that so often its a "he said she said" type of thing. Rarely are there eyewitnesses, and often no physical evidence for a variety of reasons. The lawmakers have decided to give the benefit of the doubt to the accuser, so men are prosecuted on the flimsiest of evidence. Men have to learn how to protect themselves--in other words always have an alibi--so that a false accusation would be quickly exposed. Scheck, prominent criminal attorneys and co-founders of the Innocence Project that seeks to release those falsely imprisoned.<br /><br />They stated, "Every year since 1989, in about 25 percent of the sexual assault cases referred to the FBI where results could be obtained, the primary suspect has been excluded by forensic DNA testing. Perhaps we can make a nice little graphic poster about this.<br /><br />A friend of mine was falsely accused of rape, informally and not in the legal system. Ten years later, he ran into the woman at a party. She began chatting with him cordially as though nothing had happened. He pointed out that she had accused him of rape, and she said, "I don't remember doing that, I'm so sorry."<br /><br />I lived in Berkeley in the nineties and this is not even the most egregious false accusation I've seen.
